T.S. MicroTech Inc. Limited Warranty Agreement

This TSM Warranty Agreement is made by T.S.MicroTech Inc (refer herein as TSM) located at 17109 Gale Ave, City of Industry, CA 91745. This agreement applies to any order; purchase, receipt, delivery or use of any products and services from TSM or any TSM authorized resellers and distributors. This agreement applies to your purchase unless you notify TSM in writing that you do not agree to this agreement prior to shipping the products, or giving technical support. This agreement may be changed without prior notice at TSMís discretion.
1. Limited Warranty:
The term of the limited warranty for your TSM product begins when your TSM product is shipped to you and lasts for the period stated on your invoice. One-year warranty is applied to systems. Warranty is voided if power supply or camera short out.
2. Definitions and Functionality of TSM products
Netzeye TM is designed and marketed as a digital remote management tool only. It is not a surveillance product.
3. Technical Support:
TSM will provide limited technical support for 60 days to you for your TSM product during the warranty period. The method of technical support may change at any time at TSMís discretion.
4. Limitations:
This warranty agreement does not include any type of tutorial support (tutorial is different than technical support) You may not assign or transfer this warranty. This warranty terminates when you transfer or dispose of your TSM product. This applies to end-user only. This does not apply to dealers and distributors.

You may cancel this Warranty Agreement for any reason at any time. To cancel, you must send written notice to: T.S. Microtech Service Department, 17109 Gale Ave, City of Industry, CA 91745.

TSM will not cancel this Agreement except for non-payment by you or if you commit a direct violation of this agreement. If TSM cancels this agreement, it will give you 30 days advance notice and refund 100% of the pro-rated portion of the purchase price paid by you to TSM based on the time expired (measured on a weekly basis) minus the cost of any parts/service actually applies to you.

This warranty is not available and applicable in all states and jurisdictions. Please refer and check with your local rulings.

5. What is Covered:
TSM will repair or replace eligible parts in your TSM product that are damaged under normal working environment without accidental physical damage caused by virus, impacts, dropping, falls, spilled liquids, immersion in liquids, power surges and other such natural disaster such as flood, wind, earthquake or lightning and fire, during the term of this warranty.
6. What is Not Covered:
Any loss or damage caused by intentional or accidental conduct, virus, impacts, dropping, falls, spilled liquids, immersion in liquids, power surges and other such natural disaster such as flood, wind, earthquake or lightning and fire.

TSM products with altered, modified or removed serial numbers.

Damage resulting from the use of TSM product in a manner for which it was not intended.

Normal wear or cosmetic damage and/or other damage that does not affect functionality.

7. Customer Requirements:
To obtain service under this warranty agreement, you must contact TSM technical center. TSM will then determine how and where repair services are provided and you may be required to deliver or ship your product to TSM repair facility.

You must assist TSM in diagnosing the problem with your TSM product and follow TSMís warranty processes.

You must provide copy of invoice, or invoice number to obtain technical support.

You must obtain service form TSM. TSM will not reimburst you for services performed by others.

8. Limitations:
If TSM is unable to repair or replace parts for your TSM product for any reason, TSM may choose to replace the product with a new or serviceable used TSM product, comparable in function and performance to your TSM product. In any event, TSMís maximum liability to you under this Warranty Agreement will not exceed the original purchase price (minus shipping, taxes & handling fee) of your TSM product.
9. Payment Terms:
You are responsible for paying all taxes, shipping & handling associated with your order. No cash refund. All refunds are subjected to a 14-day waiting period. A credit memo will be issued in place of a refund check. There will be a $25 charge on all returned checks. Customers are personally liable for any fees incurred in the collection process. Payment is due at the time stated on your invoice or when product is shipped.
10. Shipping & Title:
TSM will arrange to ship products to you. Title to products passes to you when TSM delivers them to the shipper and risk of loss passes to you when shipped delivers products to the address you designate. Title to the software remains with the licensor of the software. Your use of software is subject to license agreement applicable to the software. YOU MUST NOTIFY TSM OF ANY DAMAGE OR MISSING ITEMS FROM YOUR ORDER WITHIN 15 DAYS AFTER YOU RECEIVE YOUR PRODUCT.
11. Return Policy:
You may return products and cancel unused service within 30 days after you receive your products. No return or refund on special order items. Warranty will be voided if the warranty sticker is removed from systems. TSM will refund the original purchase price of products, unperformed service and related sales taxes. SHIPPING & HANDLING FEES (INCLUDED RELATED SALES TAXES) ARE NOT REFUNDABLE. YOU ARE RESPONSIBLE FOR PRODUCTS UNTIL TSM RECEIVES THEM. YOU WILL BE CHARGED SHIPPING AND HANDLING AND RESTOCKING FEES (25%) TO RETURN PRODUCTS. Return products must be in the same condition as you received them. You must return all pre-loaded software with the product to obtain a refund for the product. You may return other software only if the package has not been opened.

There is no return for Microsoft Windows XP

12. Tehnical Support:
TSM will provide technical support for products at no additional charge for 60 days from the date of shipment or invoice or if longer, the period stated in your service package. TSM will only support products which you purchased from TSM. TSM DOES NOT GUARANTEE THAT SOFTWARE OR WINDOWS WILL BE FREE FROM ERROR, EITHER IN ISOLATION OR IN COMBINATION WITH HARDWARE.
13. Disclaimer of Warranties; Limitation of Liability
EXCEPT FOR THE WARRANTIES EXPRESSED IN THIS AGREEMENT, TSM DISCLAIM ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED. INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER APPLICABLE LAW. THE TERM OF ANY IMPLIED WARRANTIES THAT CANNOT BE DISCLAIMED ARE LIMITED TO THE TERM OF THIS AGREEMENT. TSMíS AND YOUR MAXIMUM LIABILITY TO THE OTHER IS LIMITED TO THE PURCHASE PRICE YOU PAID FOR PRODUCTS OR SERVICES PLUS INTEREST AS ALLOWED BY LAW. NEITHER YOU NOR TSM IS LIABLE TO THE OTHER IF YOU OR IT ARE UNABLE TO PERFORM DUE TO EVENT YOU ARE IT ARE NOT ABLE TO CONTROL, SUCH AS ACTS OF GOD, OR FOR PROPERTY DAMAGE, PERSONAL INJURY, LOSS OF USE, INTERRUPTION OF BUSINESS, LOST PROFIT, LOST DATA OR OTHER CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES. HOWEVER CAUSE, WHETHER OF BREACH OF WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE). STRICT LIABILITY OR OTHERWISE, OTHER THAN THOSE DAMAGES THAT ARE INCAPABLE OF LIMITATION, EXCLUSION OR RESTRICTION UNDER APPLICATION LAW. THIS AGREEMENT GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
14. General:
This agreement may not be modified, altered or amended without written approval of TSM. This agreement shall be interpreted under the laws of the state of California, without giving effects to conflicts of law rules.
15. Tehnical Support:
